Sharing a brilliant comment i read (1)

(Copy pasted)I've been thinking of this and I didn't want to bring it up but decided that perhaps we should examine terrible 4's actions when they were still kids from a legal and psychological perspective.First break down of facts:1) In Ho was driving the car with his friends and the poor boy there were bullying in tow. He was reckless, the night had set in, the street was curving and dark.2)A little girl was walking alone at night. She hears a speeding car, next hears the HONKs, she turns but is too slow. The Run hits her.3)The boys rush out. They are scared by the tone of their voices and look on their faces. Tae Suk picks up the phone and calls their Noona whom they all are attached too. She is Older. A teenager with the mental capacity of judgement and responsibility. She advises them to get rid of the body.4)She has closely manipulated the boys since they first met her. She uses her femininity as her means of control over boys who have crushes on her. After the incident, she is also the one without remorse who plans and instructs the boys NOT to take responsibility.5)The boys drag the body of the girl fearing that the car accident killed her only to discover she was still alive. In a moment of panic it is decided that it is too late to back off. Just throw the body.Laws in particular US Laws:1)The accident is exactly that by the law an accident. Meaning there was no malicious intent and no planned killing. It was childhood stupidity and even if an full grown adult was behind the wheels the Law would recognize an Accident as a tragic loss of life(unless the driver was drunk then it is manslaughter if an adult).2)In Ho is not guilty of murder because of the car accident. However, he is responsible for killing the girl by dumping her body. All of the 4 children share equal responsibility with the poor bullied boy having the least due to his impaired mental status.3)Even though all 4 children share responsibility for killing the girl they do qualify to be tried in a court of law as minors. The law in USA and in most global countries recognizes that children cannot be held to the same legal standards as full grown adults.(this is because medicine and psychology both prove that children's brains are not fully developed. This means even if they are old enough to understand what is wrong and what is right they still cannot fully comprehend the magnitude of their actions nor the consequences.)(Take the 4 boys as example. After the incident they were all scared and a few even shed tears. They committed a crime but they were not criminal masterminds nor did they understand the situation to its fullest. Now compare it to the older teenage Noona. She knew what she was doing. In this circumstance, she would actually be the primary criminal. She instigated the death of the girl and facilitated the cover up)4)While the 4 kids qualify for trial in Juvenile court that doesn't mean they cannot be tried for murder. Minors can be convicted for murders under special circumstances.5)However, it is to be notes in unusual and heinous crimes of murder where intent, planning, hate etc is visible the law does allow a Minor to be charged as an adult.Analysis: Given both the facts and the laws in place I believe that while all 4 of them committed a murder at that point in time and at that age they should be tried as Minors. With Noona taking on the the murder charge as an adult. Furthermore, I believe given her control over the children they should have not been tried for murder but given a lighter sentience such as manslaughter.Additional Analysis: Children who commit crimes and get away with them and are continued to be raised with bad influences and under the control of a sadistic Noona the boys had NO opportunity to grow up and become better people. They never learned responsibility, they never learned remorse, they never learned the value of life. Given their present situation it is not a surprise that one is posed to become psychopathic Killer who gets pleasure from killing while another is a sadist enjoying torching others with no regard to a person, one had become entangled in the Noona's web and was blackmailed into getting back into a relationship. He was blinded by his own thoughts, his own wants and his own needs and didn't even realize he treated his wife like a dictator and that he should be ashamed for cheating. And lastly, the weakest one had turned to drugs to cope with the pressures of society, family expectations and the ghosts from his past. He was helped along by Noona to seek comfort in drugs.Analysis of Lawyer: Given her history unto today her life has been heartbreaking. She suffered loss like which no parent should ever have to face. She did not get justice because the boys were 1) rich and 2)Minors. She almost died in a fire designed to take her life. She wanted to die but continued living for one purpose alone. Revenge. As a human being I can understand and sympathize with her. However, I cannot condone the Serial Murders she has committed up to now. If revenge was her point then first of all the targets should be directly those who killed her child. While officials and medical examiner were corrupt and took bribes they should never have been murdered. That is Not even revenge. That is Vigilante action where the punishment she gave them(murder/death) was greater than their crimes(accepting bribes and cover up). In society, laws are made because crimes cannot go unpunished but Justice is measured. Punishment must fit the crime. She is someone I feel for and am so sorry for and yet her Serial Murders are not forgivable. Unlike 4 scared boys under the influence of the Noona. She is an adult, brain fully developed. She knows and understands not only the crime but also all the implications. And what's worse she is a lawyer. Instead of holding up the law and teaching others to seek Justice she is out being a Vigilante killing those she deems necessary to complete her master plan of revenge.Analysis of Detective: After his own story from his Minor days is revealed he is someone we can look to in a new light. He is an example of the Justice system working correctly. He committed a crime as a minor, he stood trial and he was punished for it according to Juvenile laws. He learned responsibility and about consequences. He learned remorse and developed a desire to live his life helping others. He is also an example of why children are held to different legal standards. Children can be reformed easier. Also, he is a reminder to the boys that they need to own up their crimes. And finally, he is the voice of reason who tries to bring the lawyer and his junior partner back from the brink of no return. He is a naive man wanting to protect them but he is also a good man who understands the complexity of emotions, guilt, burdens, crimes, laws, and the insufficient justice so many victims face. Yet, in the face of all the bad he refused to become as dark as them.
